Decision and Rights
Grant of Leave to Remain
Successful applicants are normally granted leave in line with the main applicant’s permission. This allows lawful residence in the UK subject to ongoing compliance with immigration conditions.
Indefinite Leave to Remain (ILR)
After completing the required period of continuous lawful residence, family members may become eligible to apply for settlement, subject to meeting the relevant requirements.
Additional Considerations
- Each application is assessed on individual circumstances.
- Incomplete evidence may result in delays or refusal.
- Consistency with the main applicant’s status is essential.
- Legal advice can significantly improve success prospects.
Applications By Family Members Of Stateless Persons
Applicants applying from outside the UK must submit an entry clearance application supported by relationship evidence and documentation confirming the sponsor’s immigration status.
Applicants may apply to extend their visa before expiry if they continue to meet all requirements. Updated evidence and ongoing eligibility must be demonstrated.
Where residence and eligibility requirements are met, applicants may apply for Indefinite Leave to Remain following a qualifying period of lawful stay.
